OBJECT AND SCOPE OF APPLICATION

These General Terms and Conditions of Online Sale apply to Users and Customers of the WEBSITE WWW.SAMADISURFSKATE.COM ... as well as to any commercial transactions carried out through the SAMADI Online virtual store available on the same website.

Browsing the WEBSITE, as well as purchasing any Product from the SAMADI Online virtual store, implies acceptance of these General Terms and Conditions of Online Sale by the Customer, as well as acceptance of the terms and conditions of the WEBSITE WWW.SAMADISURFSKATE.COM.

SAMADI reserves the right to change these General Terms and Conditions of Online Sale without prior notice, with any changes being published on the website WWW.SAMADISURFSKATE.COM.

RESPONSIBILITIES

SAMADI is not responsible for damages resulting from interference, interruptions, computer viruses, malfunctions, or disconnections of the operating system that may temporarily prevent access, browsing, or the provision of services to Clients.

Under no circumstances shall SAMADI and/or its representatives and employees be liable for any damages that may arise, even accidentally, from the malfunction of this WEBSITE, for any reason whatsoever and for any duration thereof, or for any damages caused by reproduction, use or exploitation that violates the provisions of these General Terms and Conditions of Online Sale.

SAMADI disclaims any responsibility for any delay or impossibility in processing the order, especially at the time of delivery, resulting from errors or insufficient data provided by the Customer.

CUSTOMER OBLIGATIONS

The Customer undertakes to comply with and respect these General Terms and Conditions of Online Sale, as well as all policies associated with them, namely:

ONLINE ORDER PLACEMENT

Validation of the purchase order implies that the Customer has acknowledged and expressly accepts these General Online Sales Conditions, as well as the respective Terms and Conditions of the WEBSITE WWW.SAMADISURFSKATE.COM, available for consultation on the same website. The data recorded by SAMADI constitutes proof of all transactions carried out between SAMADI and the Customer. It is SAMADI's responsibility to archive the electronic documents formalizing the sale of the Product and keep them accessible should the Customer request it.

Once your purchase is complete, you will receive an automatic email confirming the transaction. If the information is incorrect, you can immediately request its correction.

SHIPPING COSTS

Shipping costs to an address specified by the Customer are calculated according to the Product(s) purchased and the total order value. The total shipping cost is displayed before finalizing the purchase process and after indicating the delivery address.

For mainland Portugal and orders over €49.99, shipping is free.

In other cases, the table below applies.

PRODUCT AVAILABILITY

The product catalog of WWW.SAMADISURFSKATE.COM (SAMADI Online virtual store) is independent of physical stores, both in terms of price and stock quantities. All promotional campaigns have limited stock and are exclusive to online sales.

SAMADI only processes an order placed by a customer after confirmation of the respective payment, so SAMADI cannot guarantee the availability of items until the start of the aforementioned processing.

SAMADI only ships on business days.

The normal delivery time for each product should not exceed 5 (five) business days.

If any ordered product is unavailable, SAMADI will contact the customer if the delivery time or the price of the item changes, and the order will only proceed after the customer's consent.

In the event of absolute unavailability of the ordered Product, SAMADI may offer the Customer a Product of equivalent quality and price, if available, and in this case, the order will only proceed after the Customer's consent.

In the event of absolute unavailability of the ordered Product, and if it is not possible to offer the Customer any Product of equivalent quality and price, or if the Customer has not given their consent to the alteration of the initially placed order, SAMADI will refund the amounts paid by the Customer within a maximum period of 14 (fourteen) days after notification of the cancellation.

Any delay in the shipment of items, considering the estimated dates presented, does not entitle the Customer to any compensation.

CANCELLATIONS, EXCHANGES AND RETURNS

The Customer may cancel their order at any time until shipment, however, they must bear the costs incurred by SAMADI in the operation.

Upon receiving the order, the Customer may exercise their right of withdrawal under the legally established terms and conditions indicated below, in particular, in Decree-Law No. 24/2014, of February 14.

Failure to pay for the order within 48 (forty-eight) hours following the date on which it was definitively placed will result in its automatic cancellation.

In accordance with the provisions of Decree-Law No. 7/2004 of January 7 (as amended by Decree-Law No. 62/2009 of March 10 and Law No. 10/2009), SAMADI or the Client may cancel the contract if the message arrives distorted at its destination due to an error in message transmission.

According to applicable legislation, SAMADI allows the exchange or return (contract termination) of items within a maximum period of 14 (fourteen) days from the date of receipt by the Client, without payment of compensation and without the need to state a reason.

The Client has the right to terminate the contract without incurring any costs within 14 (fourteen) days from the day following the day: (i) on which the Client or a third party indicated by the Client, other than the carrier, acquires possession of the goods or in the case (ii) on which the Client or a third party indicated by the Client, other than the carrier, acquires possession Physical delivery of the last item when the consumer has ordered several items in a single order and the items are delivered separately.

In order to exercise their right of withdrawal, the Customer must communicate their decision to withdraw from the contract by means of an unequivocal statement addressed to one of the means of communication present in these General Terms and Conditions of Online Sale.

For the withdrawal period to be respected, it is sufficient that the communication concerning the exercise of the right of withdrawal is sent before the end of the withdrawal period.

In case of withdrawal, the Customer will be reimbursed for all payments made, without undue delay and, in any case, at the latest 14 (fourteen) days from the day on which SAMADI receives the returned Products.

Refunds will be made using bank transfer, and the Customer must provide the IBAN for this purpose.

SAMADI hereby informs that it may withhold reimbursement until it has received the returned goods, or until the customer provides proof of shipment of the goods, whichever occurs first.

The Customer must return the goods without undue delay and at the latest 14 (fourteen) days from the day you informed SAMADI of your decision to freely terminate the contract, it being considered that this period is respected if the Customer returns the goods before the end of this 14 (fourteen) day period.

In the case of returning goods that, by their nature, cannot normally be returned by mail, the Customer must bear the direct costs of said return, which are associated with shipping costs.

If you wish to exchange items, the Customer may contact SAMADI Customer Service, which will provide all the information about the exchange process. The Customer should not, under any circumstances, send items to SAMADI without prior contact, as they will not be received.

When returning and exchanging items, the Customer must respect the following conditions:

Return of items in good condition, with complete original packaging and accompanied by the respective cash register receipt or original invoice;

The items must contain their respective label.

All items will be checked upon arrival at our service and only those that meet the return conditions will be accepted for exchange or return.

CONSUMER GOODS WARRANTY

In accordance with the provisions of Decree-Law No. 67/2003, of April 8 (as amended by Decree-Law No. 84/2008), of May 21, all Products sold on WWW.SAMADISURFSKATE.COM are covered by a warranty of conformity of goods.

However, the warranty on Products such as clothing, fashion accessories and any other fast-wearing goods will only prevail if the Product has not been used, is as delivered (including label) and presents non-conformities.

For all purposes, according to applicable legislation, the Product is in conformity if:

The goods must meet the following conditions

There is no lack of conformity, within the meaning of applicable law, if, at the time the contract is concluded, the consumer is aware of this lack of conformity or could not reasonably be unaware of it, or if it arises from the materials supplied by the consumer.

If the purchased Product has a manufacturing defect or is not in conformity, the Customer must notify SAMADI, informing them of their order number and a description of the non-conformity. The costs of returning or collecting items within the warranty period will be borne by SAMADI.

After receiving the item at SAMADI's premises, it will be... After verification, and if any non-conformity is proven, the item will be replaced. In this case, SAMADI will replace the Product and send a new one to the Customer's address at no additional cost.

APPLICABLE LAW

All purchases made on the website WWW.SAMADISURFSKATE.COM are subject to Brazilian law. Any conflict or divergence in the interpretation of the General Terms and Conditions of Online Sale will be submitted to the competent Portuguese court.

If the Customer is outside of mainland Portugal, SAMADI hereby informs that any legal proceedings must be brought before the Portuguese courts.
